STATE OF NEBRASKA SS. COUNTY OF HALL CHRISTOPHER J. HARROUN, DEPUTY HALL COUNTY ATTORNEY, of Hall County, being first duly sworn on oath, deposes and says that to the best of your affiant's information and belief, it appears that the above-named minor children are within Hall County, Nebraska and are 15, 13 and 12 years and 2 months of age, 03/2005, 03/2007, 08/2008 and 12/2020, and are minor children as defined under �43-247(3)(a), requests the Juvenile Court to determine whether support will be ordered pursuant to �43-290, in that said Juveniles on or between: COUNT I JUVENILE PETITION (3)(A)(3)43-247(3)(A)(3) July 1, 2020 and February 25, 2021, lacks proper parental care by reason of the fault or habits of his or her parent, guardian or custodian, to-wit: Nyareak Pech is the mother of Rouda Joshua, Tatiana Joshua, Alana Porcupine and Juol Burson. Moses Kong is the alleged father of Rouda Joshua. Quentin Porcupine is the legal father of Tatiana Joshua and Alana Porcupine. Mason Burson is the father of Juol Burson. Rouda, Tatiana and Alana have been living with Nyareak and Mason. Juol was born at St. Elizabeth's Hospital in Lincoln, Nebraska and has never been discharged from the hospital. Nyareak and Mason both struggle with alcoholism and with their mental health. Nyareak has been diagnosed with post-partum depression, but is not seeking treatment for it. When contacted by CFSS Kari Wolfe and law enforcement Mason reported suicidal thoughts. Nyareak has been consistently using alcohol since she learned she was pregnant with Juol in July, 2020. She admits that she drank multiple times a week while pregnant with Juol and that she continues to drink. Nyareak reports that when she drinks she drinks 1 to 2 pints of vodka at a time. Juol was born prematurely at 26 weeks and as a result of being underdeveloped has never left St. Elizabeth's. Juol's lungs are underdeveloped and he has higher needs as a result of his feeding schedule. Nyareak and Mason rarely visit Juol in the hospital and when Nyareak visits the doctors and nurses report that she smells of alcohol. Nyareak and Mason's drinking has led to violence in their home. Rouda, Tatiana, and Alana report being frightened of Mason when he drinks and being worried about both Nyareak and Mason when they drink. Nyareak reports that on February 22, Mason scratched her multiple times causing her pain and that he pulled some of her hair out. This occurred in the family home. Rouda reported that she heard Nyareak and Mason fighting and that she saw blood on Nyareak's face due to being scratched by Mason. Tatiana and Alana reported to CFSS Wolfe that they do not feel safe around Mason because of this. Mason admitted to CFSS Wolfe and to law enforcement that he had scratched Nyareak. Mason reports he had been sober for 9-12 months before this incident, but that he started drinking again and was drunk when he scratched Nyareak; COUNT II JUVENILE PETITION (3)(A)(4)43-247(3)(A)(4) July 1, 2020 and February 25, 2021, is/are juveniles whose parent, guardian or custodian neglects or refuses to provide proper or necessary subsistence, education or other care necessary for the health, morals or well-being of such juveniles, to-wit: Nyareak Pech is the mother of Rouda Joshua, Tatiana Joshua, Alana Porcupine and Juol Burson. Moses Kong is the alleged father of Rouda Joshua. Quentin Porcupine is the legal father of Tatiana Joshua and Alana Porcupine. Mason Burson is the father of Juol Burson. That said children are not now inmates of any state or national institution or of any orphanage, school, society or institution incorporated under the laws of the State of Nebraska or of any other state or of the United States. That the names and addresses of the parents and/or person having custody and control of said children are as follows: NAME OF JUVENILES NAME & ADDRESS OF PARENT/CUSTODIAN JUVENILES JOSHUA- PORCUPINE-BURSON NYAREAK GATWECH PECH 108 W 10TH ST GRAND ISLAND, NE 68801 WHEREFORE, petitioner prays that said children be corrected or cared for according to law and the duty of the State in the premises; that pursuant to Neb.Rev.Stat. �43-257(5) the JUVENILE COURT takes jurisdiction of the parent, guardian or custodian of said Juveniles; and, in the event that the care and custody of the Juveniles is placed other than with the parent, that the Court order the parent or parents of the Juveniles pay a reasonable amount of support to cover in whole or in part the support, study and treatment of the Juveniles. /s/CHRISTOPHER J.
