NOTICE TO DEFENDANTS TO: Defendants, Andrew L. Aken, Spouse of Carolyn K. Gulzow, real name unknown, and the Estate of Fred W. Gulzow, and the Heirs, Legatees, Devisees, Personal Representatives, and All Other Persons Interested in the Estate Fred W. Gulzow, Deceased. Notice is hereby given that on the 18th day of March, 2021, Nationstar Mortgage LLC d/b/a Mr. Cooper, as plaintiff, filed its Complaint against Andrew L. Aken and Heidi L. Aken, husband and wife, Spouse of Carolyn K. Gulzow, real name unknown, and the Estate of Fred W. Gulzow, the Heirs, Legatees, Devisees, Personal Representatives, and All Other Persons Interested in the Estate Fred W. Gulzow, Deceased, as the defendants, Case No. 21-284, in the District Court of Hall County, Nebraska, the object and prayer of such Complaint to obtain an Order declaring that the defendants, Spouse of Carolyn K. Gulzow and the Estate of Fred W. Gulzow, the Heirs, Legatees, Devisees, Personal Representatives, and All Other Persons Interested in the Estate Fred W. Gulzow, Deceased, have no right, title, interest or lien in the real estate described below; that ownership in the real estate be declared quieted and cleared in the name of Heidi L. Aken; and for the Court to enter an Order providing that the legal description contained in the Quitclaim Deed, as set forth in paragraph 8 of the Complaint, be reformed to provide as follows: A tract of land comprising a part of the South Half of the Southwest Quarter of the Southwest Quarter (S1/2SW1/4SW1/4) of Section Twenty Seven (27), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, and more particularly described as follows: Beginning at a point on the east line of said South Half of the Southwest Quarter of the Southwest Quarter (S1/2SW1/4SW1/4), said point being Sixty Seven (67.0) feet north of the Southeast corner of said South Half of the Southwest Quarter of the Southwest Quarter(S1/2SW1/4SW1/4), and being a point on the northerly right of way line of U.S. Highway No. 34 & 2; thence running northerly, along and upon the east line of said South half of the Southwest Quarter of the Southwest Quarter (S1/2SW1/4SW1/4), a distance of Three Hundred Eighty Eight and nine tenths (388.90) feet to a point, said point being Two Hundred and Three Tenths (200.30) feet south of the Northeast corner of said South Half of the Southwest Quarter of the Southwest Quarter (S1/2SW1/4SW1/4); thence running westerly, parallel with the south line of said South Half of the Southwest Quarter of the Southwest Quarter(S1/2SW1/4SW1/4), a distance of one Hundred six (106.0) feet; thence running southerly, parallel with the east line of said South Half of the Southwest Quarter of the Southwest Quarter (S1/2SW1/4SW1/4), a distance of Three Hundred Eighty and Nine Tenths (380.90) feet to a point on said highway right of way line, said point being Seventy Five (75.0) feet north of the south line of said south Half of the Southwest Quarter of the Southwest Quarter (S1/2SW1/4SW1/4); thence running easterly, along and upon said northerly highway right of way, a distance of One Hundred Six and Three Tenths (106.30) feet to the point of beginning.
